Guarantee and Listing:
Listing of any group either on Human Harmony Entertainment or in any other way
with the Human Harmony Productions shall be at the sole discretion Human Harmony
Entertainment. Human Harmony Entertainment does not make any promise or guarantee that
artist’s registering or becoming a member will list as a performer or group through
Human Harmony Entertainment. Human Harmony Entertainment further does not promise,
warranty or guarantee that a performer or act shall receive any bookings or distribution
by registering as an act available through Human Harmony Entertainment. Any promotional
materials provided to Human Harmony Entertainment will not be returned, even in the event
that Human Harmony Entertainment does not choose to make the act available through Human
Harmony.com. Any information or promotional material provided by a performer or act will
be considered marketing materials for that performer or act by Human Harmony Entertainment
and may be used in any way reasonable to do so for purposes of obtaining bookings for that
performer or act. Any material provided might be edited or changed to suit both the format
of Human Harmony Entertainment's marketing efforts and for content, which Human Harmony
Entertainment may feel, is appropriate for publication. Human Harmony Entertainment does
not guarantee Artist’s sales and is not responsible for lack of interest in
Artist’s music. Human Harmony Entertainment can not be held liable for Artist’s
dissatisfaction with the website and or Internet presence created by humanharmony.com.
Commissions and Payment:
Human Harmony Entertainment makes a commission for booking entertainment for any client who books an act as a result of having found them through Human Harmony.com advertising or print medium including those performers and acts which may not have an "exclusive" booking arrangement with Human Harmony Entertainment. This commission is in the form of a fee charged to a client in reference to Human Harmony Entertainment performance plan fee. At the time of booking and contracting a performer or act will have a guaranteed, contracted fee that they will have agreed to prior to performance. The commission is set at a rate that depends on venue type length of performance, # of artists, song length and location. There may be other costs associated with the booking engagement, which may be considered administrative cost charged to the client.
Many artists offer a discount on their standard fee in consideration for marketing and contracting services provided by human harmony. Since this makes the Artists more marketable to potential clients all terms of booking will be agreed upon verbally or by email prior to the execution of the engagement. Payment will be sent out once a week in the form of check for all performances for that week. Human Harmony Entertainment in most cases will act as the agent of a artist booked through Humanharmony.com and will book an artist as "Work for hire" for each specific engagement. If a artist has an exclusive manager, Human Harmony Entertainment is happy to work with that individual or company as the primary booking contact so long as proper information for contact is provided.

Artist’s members are responsible for submitting all materials to be included in their
profile, including music, photos and other artwork, videos, biographical information and
reviews. Submitted materials cannot be returned.
Music: Songs may not be longer than 3 1/2 minutes, and must be in MP3 or RA format.

Photos/Artwork: B&W or color. Artwork should be submitted during signup. Artwork not on disk should be image ready and of the highest
possible contrast. And sent to humanharmony.com
Reviews: Must be limited to two paragraphs and may be randomly chosen for "Harmony
player of the day".
License: Artist’s members hereby grants to Human Harmony Entertainment
license to exploit the materials provided to Human Harmony Entertainment hereunder in any
and all media now known or undiscovered hereafter throughout the world.
Permission:
Artists will obtain all permissions, under copyright or otherwise, necessary for the
lawful display of any materials and/or merchandise provided to Human Harmony Entertainment
by Artist’s for incorporation promotion or exploitation of artist for booking said
artist. Artist’s warrants that they are the sole rights owners, or they have received
permission from the song rights owner to use said song in conjunction with any service.
Artist’s waives the right to receive royalties in conjunction with the Artist’s
material or product (song) used on any Human Harmony Entertainment service or performance.
The material and merchandise provided to Human Harmony Entertainment by Artist’s for
incorporation into and sale through the site shall not violate any copyright, trademark
right, right of publicity, or any other right of any kind of any person and shall
constitute permission and fair use under the agreement of this contract.
Representation:
Artist’s Represents and Warrants that;
A. Artist’s has the right and authority to enter into this agreement;
B. Artist’s has not entered into any agreement or been promised compensation under
this agreement; and
C. The material and merchandise provided to Human Harmony Entertainment by Artist’s
for incorporation into and sale through the site shall not violate any copyright,
trademark right, right of publicity, or any other right of any kind of any person and
shall constitute fair use.
Indemnification:
Artist’s shall indemnify and hold harmless Human Harmony Entertainment from any and
all liability and/or costs (including court costs and attorneys fees) arising from any
claim or potential claim alleging a breach of the representations and warranties made by
Artist’s in this agreement.
This agreement is the entire agreement between the parties and cannot be modified,
assigned or amended without the prior written consent of Human Harmony Entertainment. Any
purported modification, assignment or amendment is in violation of this paragraph and
renders the Entire Agreement null and void and of no force or effect. The waiver by Human
Harmony Entertainment of any breach of the terms and conditions of this agreement by
Artist’s shall not constitute the waiver of any subsequent or similar breach.
Limitation of Damages: Human Harmony Entertainment shall have no liability to
Artist’s for non-performance, destruction, defamation un-orderly conduct or events
beyond its control. Human Harmony Entertainment shall not be liable to Artist’s for
any damages including, but not limited to, consequential, incidental and punitive damages,
under any circumstances whatsoever, even if advised of the possibility of such damages.
State of law:
This agreement, and the rights and liabilities of the parties arising under this
agreement, shall be governed by and construed in accordance with the laws of the State of
Washington applicable to agreements to be completely performed therein.
This policy may be changed or amended and all registered performers and acts agree that
the current policy shall supercede any previous policy.
